Appeal against a gambling licensing decision

If you do not agree with the outcome of a licensing decision or any of its conditions, if you were the applicant or member of the public, you can appeal through the courts against the decision of the Licensing Authority.

What can be appealed

Appeals can be made about a decision on an application for a:

  • premises licence
  • variation to an existing licence
  • Review of an existing licence
  • transfer of premises licence
  • provisional statement
  • permits

Who can appeal

Anyone can appeal a decision if they think:

  • the licence should or should not have been granted
  • the Licensing Committee should have imposed different, less or extra conditions on the licence

How to appeal

You should appeal in writing to:

You must make your appeal within 21 days of being formally told of the Licensing Committees’ decision in writing.

Appeal hearings

Before the hearing, all parties will get:

  • confirmation that a Party may be assisted or represented by a person whether or not that person is legally qualified
  • confirmation that a Party to the hearing may address the Authority, give further information on a point on which the Authority requires clarification and, if considered by the relevant committee to be required, question another Party to the hearing 
  • the consequences of not attending or being represented at a hearing (which normally will be that the hearing will proceed in the Party’s absence)
  • a note of any particular points on which the Authority wants clarification
  • a copy of the gambling hearing protocol

If a hearing is cancelled

We may cancel the requirement to hold a hearing if all parties agree and have notified us that a hearing is unnecessary.

If we decided to cancel the hearing, we will proceed to determine the outcome of the application, after which all parties will be notified.

Where hearings take place

Hearings normally take place at the Town Hall, Katharine Street, Croydon.

After a hearing

The court tells all interested parties of its decisions, and the reasons, within 3 working days. 

There is a further right of appeal from the magistrate’s court to the High Court.
