Proposed submission draft of the Croydon local plan 2019 to 2039

The Regulation 19 Consultation has now closed.

The purpose of the Regulation 19 consultation is to provide an opportunity for representations to be made on the amendments to the local plan before it is examined by a planning inspector. In accordance with the Planning and Compulsory Purchase Act 2004 (PCPA), the planning inspector will consider all comments on the plan that are made within the consultation period.

The consultation ran from 6 January 2022 to 17 February 2022.

The Regulation 19 consultation follows on from the Regulation 18 consultation that took place between November 2019 and January 2020. The representations received during this consultation have been used to feed into the review of the local plan 2019 to 2039.

Legal compliance

To ensure legal compliance, the revised local plan should:

  • have been prepared in accordance with our latest local development scheme
  • be accompanied by a sustainability appraisal and habitat regulations assessment
  • have a consultation carried out in accordance with our statement of community involvement
  • comply with all relevant laws including the PCPA and the Town and Country Planning (Local Planning) (England) Regulations 2012.  
  • be in general conformity with the London Plan (formally known as the Spatial Development Strategy)

We should also have worked collaboratively with neighbouring authorities and prescribed bodies on strategic and cross boundary matters, known as the duty to cooperate.

Soundness

To ensure the local plan is sound, it should meet the following criteria:

Positively prepared

Provides a strategy which, as a minimum, seeks to meet Croydon’s objectively assessed needs and is informed by agreements with other authorities, so that unmet need from neighbouring areas is accommodated where it is practical to do so and is consistent with achieving sustainable development.

Justified

An appropriate strategy, taking into account the reasonable alternatives, and based on proportionate evidence; 

Effective

Deliverable over the plan period, and based on effective joint working on cross-boundary strategic matters that have been dealt with rather than deferred, as evidenced by the statement of common ground; and 

Consistent with national policy

Enabling the delivery of sustainable development in accordance with the policies in this Framework and other statements of national planning policy, where relevant.
