Applications subject to s.106 Agreements

When Planning Applications are the subject of a s.106 Agreement the Planning Case Officer will instruct the Democratic & Legal Services Division to prepare the documentation once the application has been validated.

The Applicant will need to provide up to date H M Land Registry Office Copy Entries showing the freehold title for the whole of the planning application site before a draft Agreement will be sent out to the Applicant or their solicitor.   

The first draft of any s.106 Agreement will be provided by the Authority to the applicant.  First drafts submitted by an applicant will not be accepted.

It is provided so that applicants may be aware of the nature of the s.106 Agreement terms that may be required but may be amended or revised by the Council from time to time.

Please contact the Planning Case Officer dealing with your application who will be able to confirm whether instructions have been sent to the Democratic & Legal Services Division and which lawyer has conduct of the case.
